Tour Participation Agreement

Recitals

1. Tour Operator is in the business of organizing and conducting walking pilgrimage tours in Wisconsin.
2. Participant desires to participate in the tour designated below (the "Tour").
3. This Agreement sets forth the terms and conditions under which Tour Operator will provide services and accommodations for the Tour and under which Participant agrees to participate in the Tour.

NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:

2. Assumption of Risk

I am voluntarily participating in the Tour with knowledge of the potential risks and dangers involved, which include but are not limited to: physical exertion for which I am not prepared; forces of nature; weather extremes; transportation failures; illness or accident; consumption of alcoholic beverages; risks associated with food or impure water; civil unrest; terrorism; criminal activity; quarantine; property damage; and other unforeseen circumstances. I hereby assume any and all risks, known or unknown, of injury or death to myself or of damage to my property.

3. Health and Fitness

I represent that I am in good health and physical condition and am able to undertake a walking pilgrimage tour. I understand the Tour may require physical exertion, including walking up to twenty (20) miles per day over varied terrain. I have consulted with a physician and I am free from any medical condition that would make my participation in the Tour hazardous to myself or others. I agree to inform the Tour Operator of any pertinent medical conditions.

4. Waiver of Ordinary Negligence Claims and Release of Liability

I, for myself, my heirs, successors, executors, and subrogees, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS Tour Operator, its directors, officers, agents, employees, and volunteers ("Released Parties") from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys' fees) which are related to, arise out of, or are in any way connected with my participation in the Tour, for any loss or damage to person or property caused by the ordinary negligent act or omission of the Released Parties.

5. Waiver for Minors (If Applicable)

I, as a parent or legal guardian of the below-named minor, hereby give my permission for my child to participate in the Tour. I acknowledge and agree that I have read and understood the terms of this Agreement and that I am executing this Agreement on behalf of myself and the minor. While parents in Wisconsin cannot waive a minor child's legal claims, I agree to indemnify and hold harmless the Released Parties from any claims, actions, or liabilities brought by or on behalf of the minor arising from the minor's participation in the Tour to the extent such claims arise from the ordinary negligent act or omission of the Released Parties.

6. Scope of Waiver and Release

I expressly understand and agree that the waiver and release provisions of this Agreement apply only to claims for loss or damage caused by the ordinary negligence of the Released Parties. This waiver and release does not apply to claims arising from reckless conduct, gross negligence, or intentional or willful acts by the Released Parties.

7. Wisconsin Recreational Immunity

I acknowledge that Wisconsin's recreational immunity statute, Wis. Stat. § 895.52, may provide additional protections to property owners from liability for injuries sustained during recreational activities, including walking. This statute may operate independently of this contractual agreement to limit liability for ordinary negligence.

8. Photographic Release

I grant Tour Operator the right to take photographs and videos of me during the Tour and to use them for promotional purposes without compensation.

9. Cancellations and Refunds

All cancellation requests must be submitted in writing. Cancellation fees are as follows: [Insert cancellation fee schedule]. No refunds will be made for unused services.

10. Itinerary Changes

Tour Operator reserves the right to make itinerary changes when necessary or advisable for the comfort and safety of the participants.

11. Participant Conduct

I agree to act in a manner that does not endanger myself or others and to comply with the instructions of the tour leaders. Tour Operator reserves the right to dismiss any participant from the Tour at any time without refund for conduct that is detrimental to the group.

12. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any legal action arising out of this Agreement shall be brought exclusively in the state or federal courts located in Wisconsin.

13. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and representations.

Acknowledgment of Waiver of Ordinary Negligence Claims

By signing below, I acknowledge that I have carefully read this Agreement, understand its contents, and I am specifically agreeing to the provisions of Paragraph 4, which waives my right to bring a claim against the Tour Operator and other Released Parties for damages arising from their ordinary negligence.

I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE.
