These Terms and Conditions (the "Terms") govern your relationship with Wisconsin Way Pilgrim Tours, LLC ("WWPT," "we," "our," or "us"). By booking a tour, you agree to be bound by these Terms, which outline, among other things, our cancellation policy and certain limitations of liability. These terms affect your rights to sue, governing law, forum, and jurisdiction. Please read these Terms carefully and make sure you understand them.
Wisconsin Consumer Act Disclosure
Under the Wisconsin Consumer Act (Chapter 423), a customer may have a three-day right to cancel a consumer approval transaction. This right applies to transactions for goods or services over $25.00 that are initiated by face-to-face, mail, or telephone solicitation away from our regular place of business and consummated at your home or another off-premises location. If this right applies, within 10 days of cancellation, WWPT will refund all payments made by you and cancel any contract. Customers are not liable for any finance or other charges in such a case.
Booking and Payment
To secure your booking, you must pay a deposit of no more than 50% of the total tour cost with a maximum of $500 per individual. The final payment is due 30 days prior to the departure date, absent other arrangements made in writing and agreed upon. If the final payment is not received by the due date, we reserve the right to treat your booking as canceled.
Pricing
All prices are quoted in US dollars and are subject to change without notice. Prices are based on double occupancy. Single supplements are available upon request. Prices do not include airfare, travel insurance, personal expenses, or gratuities.
Cancellation Policy
All cancellations must be made in writing and will be effective upon receipt by WWPT. The following cancellation fees apply to tours:
| When you cancel | Cancellation fee |
|---|---|
| More than 60 days before departure | Full refund of deposit |
| Between 60 and 31 days before departure | 50% of the deposit |
| Between 15 and 30 days before departure | 50% of the tour cost |
| Between 1 and 14 days before departure | 100% of the tour cost |
We strongly recommend that you purchase travel insurance to protect yourself from any unforeseen circumstances that may cause you to cancel your tour. This cancellation policy is in addition to any statutory cancellation rights under the Wisconsin Consumer Act. Where the Wisconsin Consumer Act provides greater consumer protections, those protections shall apply.
Travel Documents
It is your responsibility to ensure that you have a valid passport and any necessary visas for your trip. We are not responsible for any costs or delays incurred as a result of your failure to obtain the proper travel documents.
Health and Fitness
Our tours are physically demanding and require a certain level of fitness. It is your responsibility to consult with your doctor to ensure that you are fit enough to participate in the tour. You must inform us of any medical conditions or disabilities that may affect your ability to participate in the tour.
WWPT makes good faith efforts to work with suppliers who comply with applicable regulations, including the Americans with Disabilities Act (ADA). We encourage travelers with disabilities to contact WWPT in advance to discuss specific needs and potential accommodations. While WWPT cannot guarantee all requested accommodations will be available, we will make reasonable efforts to assist in meeting your needs.
Accommodations
We will do our best to provide you with the accommodations described in the tour itinerary. However, we reserve the right to substitute accommodations of a similar standard if necessary.
Limitation of Liability
WWPT acts only as an agent for the various independent suppliers that provide lodging, meals, transportation, or other services connected with your tour ("Suppliers"). Such services are subject to the terms and conditions of those suppliers. WWPT and its respective employees, agents, representatives, and assigns accept no liability whatsoever for any injury, damage, loss, accident, delay, or any other incident which may be caused by the negligence, defect, or default of any company or person in performing these services. Responsibility is not accepted for losses, injury, damages, or expenses of any kind due to sickness, weather, strikes, hostilities, wars, terrorist acts, acts of nature, local laws, or other such causes. All services and accommodations are subject to the laws and regulations of the country in which they are provided.
WWPT is not responsible for any baggage or personal effects of any individual participating in the tours/trips arranged by WWPT. Individual travelers are responsible for purchasing a travel insurance policy, if desired, that will cover some of the expenses associated with the loss of luggage or personal effects.
Nothing in this agreement shall limit our liability for our own willful or wanton misconduct, our own gross negligence, or for any breach of the Wisconsin Consumer Act.
Disputes
Any and all claims, disputes, or controversies whatsoever between you and WWPT, including their agents, employees, officers, directors, and other users ("Claim" or "Claims"), shall be governed and construed in accordance with the laws of the State of Wisconsin without regard to its conflicts of laws principles. Any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert Claims in small claims court if your Claims qualify.
Class Action Waiver
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action, EXCEPT as permitted under the Wisconsin Consumer Act. Nothing in this agreement shall be construed to prohibit class action relief for violations of the Wisconsin Consumer Act (as provided in Wis. Stat. § 426.110).
If for any reason a Claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement, subject to generally applicable state law defenses such as unconscionability. An arbitration decision may be confirmed by any court with competent jurisdiction.
Governing Law
These Terms shall be governed by Wisconsin law, including the Wisconsin Consumer Act (Wis. Stat. Chapters 421-427), which provides important consumer protections. Nothing in these Terms is intended to limit any rights you may have under the Wisconsin Consumer Act or other applicable consumer protection laws. Federal law shall not supersede protections afforded by Wisconsin law.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. If the class action waiver or arbitration provision is found unenforceable under Wisconsin law, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
Modification
We may modify these Terms at any time by posting the revised terms on our website. Your continued use of our services after the posting of the revised terms constitutes your acceptance of the revised terms.
